Jay-Z’s legal team has renewed its efforts to dismiss a rape lawsuit filed against the rapper, arguing significant legal and procedural flaws. The lawsuit, filed by an anonymous woman, alleges sexual assault, but Jay-Z’s attorney, Alex Spiro, contends that the case lacks merit on several grounds.
In recent court filings, Spiro challenged the applicability of the statute under which the lawsuit was filed, noting that it became effective three months after the alleged incident. He asserts that the statute cannot be applied retroactively to Jay-Z, who has consistently denied the allegations.
Spiro also questioned the timeline and jurisdiction of the case. The accuser reportedly claimed to have been transported from Rochester to New York City for the alleged assault, but Spiro highlighted inconsistencies in her account, including the improbable 20-minute travel time, which could undermine the jurisdictional basis of the lawsuit.
Spiro further argued that the case falls outside the statute of limitations, asserting that any legal action should have been initiated before August 2021. Despite previous unsuccessful attempts to dismiss the case, Spiro plans to file a new motion seeking its complete dismissal.
The accuser’s attorney, Tony Buzbee, dismissed Spiro’s arguments as “technicalities” and expressed confidence that the lawsuit will move forward. “The law is clearly on our side and the side of alleged victims,” Buzbee told TMZ, emphasizing the validity of the case.
Judge Analisa Torres, overseeing the case, has previously criticized Spiro’s approach, describing his repeated motions as a misuse of judicial resources. She also upheld the accuser’s right to anonymity, though she acknowledged it might be lifted later to facilitate trial preparations.
In a related legal battle, Jay-Z’s team has accused Buzbee of defamation, citing public statements and social media posts that allegedly tie Jay-Z to a broader sexual assault scandal involving Sean “Diddy” Combs. Spiro has argued that these statements falsely imply that Jay-Z is under criminal investigation, calling them “defamation per se.”
