Anthony Green, convicted of first-degree murder on September 24, 2025, was accidentally released from custody just 38 minutes after his conviction. According to his attorney, a clerical error at 201 Poplar led to his release.
The murder charge stems from a June 2020 shooting in Whitehaven that resulted in the death of 27-year-old Octavious Atkins.
Police reported that Green, driving a white Mercedes SUV, opened fire on Atkins’ car at the intersection of Shelby Drive and Neely Road, killing Atkins and injuring a 49-year-old in another vehicle. Authorities said Green, identified as a suspect after the white Mercedes SUV was found burned, was arrested months later by a Mississippi Highway Patrolman.

Despite being convicted of first-degree murder, which typically carries a life sentence in Tennessee, Shelby County Court records indicate Green was released on September 24, 2025 – the same day of his conviction.
Green’s lawyer, Brandon Hall, said Green was on trial for murder even though he was already in jail for theft. He’d posted bond for the theft, but after being convicted of murder, the jail records only showed he’d paid bond for the theft. That was how he got out.
Hall told FOX13 that the paperwork confirming the murder conviction and the bond revocation hadn’t gone through yet.
“Typically, my complaint is they’re holding my clients in there too long,” Hall said. “So, the clients are getting stuck in intake. They’re sitting there for two days before they processed out. They got him out in 30 or 40 minutes.”
On September 25, a new warrant was issued for Green. FOX13 Investigates found that the warrant charges Green with first-degree murder, criminal attempted first-degree murder, and the employment of a firearm with the intent to commit a felony.
He is scheduled for sentencing on November 11.

Meanwhile, recently, in an almost similar incident, Texas police asked the public to assist them in locating an inmate who was “mistakenly released.”
Troy Dugas, 36, was “mistakenly released from jail” on August 17 at 4:30 a.m. local time, according to a Facebook post from the Harris County Sheriff’s Office (HCSO) on August 18.
“Dugas was due to begin serving a 5-year state prison sentence for assaulting a family member in Fort Bend County and a 2-year sentence for evading arrest in Brazoria County,” the HCSO wrote.
Dugas had been held in police custody since August 14, on other charges that had been dismissed, according to a separate release from the HCSO. Jail employees allegedly failed to properly document his scheduled state prison sentence and believed he was ready for release after the other charges were dropped.
